EPB Lawsuit Dismissed

That's great news. Any links forthcoming? And where was the suit filed?

This is a state trial court, so there isn't likely to be a published opinion; I don't see that the Chancery Courts in TN do that sort of thing, which isn't unusual.

From what I can gather, the case was not dismissed on the merits. The chancellor dismissed the suit for lack of jurisdiction based on the fact that the suit was not "ripe," i.e. the situation had not advanced to the point that a judicial remedy was appropriate.

In particular, the plaintiffs apparently failed to exhaust their administrative remedies. I know approximately squat about Tennessee administrative law, so I've no idea what those remedies might be, but once they have been exhausted the plaintiffs are free to refile.

This ain't nearly over.
